These Legal Policies apply to the current Middle Who Market website, operated by Multiplez LLC. Users can list items and communicate about direct transactions. Seller identity-status tools may be available where enabled, and separate paid trust services may be offered. Item-sale checkout, seller payouts, shipping integrations, paid promotion and other expanded features require separate activation and applicable terms.

Important Platform Reminder

Buyers and sellers currently arrange item payments, pickup, delivery, shipping, returns and other sale terms directly. Middle Who Market does not currently provide checkout for user-listed items, hold their purchase funds in escrow, release seller sale proceeds, issue shipping labels for those purchases, or guarantee a transaction outcome. A separate paid platform trust service may be available, but its fee is not an item purchase or buyer protection. An identity-status badge concerns identity only; a paid review request alone does not authenticate an item.

Policy Hierarchy

Read these policies together, subject to applicable law. Feature-specific terms apply when presented for that feature. Updated policies will show an effective date; material changes receive appropriate notice and any acceptance required by law or the affected feature. A policy change does not retroactively turn a direct seller deal into a platform purchase.

1. Terms of Use

1.1 Acceptance of These Terms

These Terms govern the website, accounts, listings, messages and features we make available. When creating an account, a person must affirmatively agree to these Terms and is shown the Privacy Policy. Anyone who does not agree should not create an account or use the affected account features. Viewing a public page alone does not establish that a visitor saw or accepted these Terms. Additional feature terms may apply when presented before use. Changes ordinarily apply prospectively as described in section 1.23.

1.2 Platform Role

Middle Who Market provides listings, seller profiles, discovery, messaging and related tools. Independent users may agree to a purchase directly with one another (a “Direct Seller Deal”). A listing, asking price, message, saved item or identity badge does not form an item purchase through the platform. Buyers and sellers agree to and perform their own final item-sale terms. Middle Who Market is not the buyer or seller of an independent user's listed item and does not take possession of that item merely by hosting a listing. Identity-status and other trust tools have only the scope described where they appear.

1.3 Current Item-Sale and Service-Payment Boundaries

Middle Who Market does not currently offer enabled checkout for user-listed item sales, collect an item purchase price through that checkout, hold those funds in escrow, release seller sale proceeds, issue a purchase shipping label, or operate an item-sale buyer protection program. Buyers and sellers arrange Direct Seller Deals themselves, including payment, fulfillment, authentication review if desired, returns, refunds and disputes.

The platform may separately offer its own paid trust services. Before purchasing a separately offered platform service, review its description, price, expected delivery, cancellation and refund conditions. If any are missing or unclear, do not pay and contact us first. Paying for a review or seller verification request does not itself establish that an item is authentic, approve a seller, guarantee an outcome or protect a Direct Seller Deal. Those service fees are separate from a seller's item price. Questions about a service or charge can be sent to info@middlewhomarket.com before purchase.

A report or moderation action does not promise reimbursement, delivery or a particular result in a Direct Seller Deal. This section does not exclude obligations Middle Who Market has for its own services or limit rights that applicable law does not allow to be waived. A later item-sale checkout applies only when enabled for a transaction and its applicable terms are presented; it does not retroactively convert a Direct Seller Deal.

1.4 Eligibility and Accounts

Middle Who Market account features are for adults only. A person must be at least 18 years old and legally able to enter into binding agreements under applicable law to create or maintain an account, list or offer an item, message another user, or otherwise use account-only marketplace features. A parent or guardian may not create or operate an account on behalf of a minor. We use the birthday submitted at signup to check this 18-year minimum for new accounts. Public pages may remain viewable without an account, but viewing a public page does not make a person under 18 eligible for an account or account-only features. Additional eligibility requirements may apply to particular features when presented.

Users are responsible for providing accurate, current, and complete account information and for maintaining the confidentiality of login credentials. Users may not impersonate another person or entity, create an account using false information, or create additional accounts to avoid restrictions, suspensions, moderation actions, or enforcement measures.

Middle Who Market may refuse access, suspend accounts, or terminate accounts if it believes a user is ineligible, has provided false or misleading account information, or has violated these Terms or platform policies.

1.5 Buyer Responsibilities

Buyers are solely responsible for evaluating listings, sellers, messages, comments, item details, condition descriptions, photos, pricing, availability, authenticity information, transaction terms, payment method risk, pickup arrangements, delivery arrangements, shipping arrangements, and any other information relevant to a potential purchase.

Before paying a seller, buyers should confirm in writing the item and included accessories, final amount and charges, payment method, pickup or delivery plan, expected timing, and return or cancellation terms. Review the listing carefully, ask questions and request supporting photos or documentation when needed. An identity badge does not authenticate an item or protect a payment; an “all sales final” statement does not eliminate a right that applicable law provides.

Middle Who Market does not guarantee that any listing is accurate, complete, available, authentic, lawful, safe, properly priced, or suitable for purchase. Buyers are responsible for their own due diligence and should not send payment, share sensitive information, or meet in person unless they are comfortable with the seller, item details, transaction method, and safety arrangements.

Users who choose to transact directly should preserve relevant communications, listing details, payment records, shipping records, pickup details, authentication documents, and other transaction records for their own protection.

1.6 Seller Responsibilities

Sellers are solely responsible for all listings and communications they submit through the platform. By posting a listing, the seller represents that:

The seller owns the item or has the legal right and authority to sell it.
The listing is accurate, truthful, and not misleading.
The item is not counterfeit, replica, stolen, unlawful, unsafe, restricted, recalled, or prohibited.
The seller has disclosed material flaws, damage, repairs, odors, missing accessories, uncertainty, and condition issues known to the seller.
The seller will not misrepresent authenticity, brand affiliation, condition, value, rarity, availability, or transaction terms.
The seller will not claim that Middle Who Market authenticated, inspected, appraised, guaranteed or endorsed an item or transaction. A platform-displayed identity or review status may be described only within its stated, current scope.
The seller will promptly update, pause, or remove listings that are sold, unavailable, inaccurate, incomplete, or no longer offered.

Before agreeing to a Direct Seller Deal, the seller must disclose the final item price, shipping and other charges, proposed payment method, included items, pickup or shipping method and expected timing, known material defects, and return or cancellation terms. Sellers remain responsible for legal, tax, fulfillment, refund and consumer obligations that apply to their sales, and must not suggest that applicable statutory rights are waived.

A seller profile, listing or badge does not create an agency, partnership, employment, franchise, endorsement or item-certification relationship with Middle Who Market. An identity status describes only the check stated with that status; it does not certify an item or transaction.

1.7 Listings, Condition, and Status Information

Sellers provide listing titles, descriptions, asking prices, photos, stated condition, measurements, inclusions and authenticity documents unless a field clearly identifies another source. Platform formatting, categories, search placement and seller tools do not themselves mean Middle Who Market inspected or authenticated an item. A condition label based on seller information is not an independent platform inspection or warranty.

A seller identity badge, if displayed, describes only the identity-status process stated with it. It does not establish ownership, listing accuracy, item authenticity or condition, financial reliability, shipment or payment safety. An authentication document or review indicator concerns only the item, provider, date and scope identified with it. A paid request for review alone is not an authentication result. Platform-created fields should identify their source and meaning accurately.

1.8 User Content License

Users may submit, upload, post, display, transmit, or otherwise make available content through the platform, including listings, descriptions, photos, profile information, messages, comments, and other materials.

Users retain the rights they have in original content. By submitting content, users grant Middle Who Market a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit and distribute it as reasonably needed to provide, maintain, secure and moderate the service. The license also permits display and promotion of public listing and profile content in connection with the marketplace, subject to applicable privacy settings and law. Private messages and sensitive submissions may be processed for service delivery, support, security, safety and legal purposes described in the Privacy Policy; this sentence does not license them for public promotion.

Users represent that they own or have all necessary rights to submit their content and that their content does not violate these Terms, any platform policy, any law, or any third-party rights.

Middle Who Market may remove, restrict, disable, or preserve user content at its discretion, including where it believes the content violates these Terms, violates platform policies, infringes rights, creates safety concerns, creates legal risk, or is otherwise unsuitable for the platform.

1.9 Prohibited Items and Conduct

Users may not list, offer, promote, request, or attempt to transact in prohibited items. Users may not misuse the platform, post false or misleading listings, misrepresent identity or item details, harass others, evade moderation, scrape platform data, interfere with platform operation, or use the platform for unlawful, unsafe, fraudulent, infringing, or abusive conduct.

Middle Who Market may investigate suspected prohibited conduct and take enforcement action at its discretion.

1.10 Counterfeit, Replica, Stolen Goods, and Authenticity Rules

Counterfeit goods, replica goods, stolen goods, and intentionally misleading listings are prohibited. Replica items are prohibited even if the listing discloses that the item is a replica, imitation, inspired-by item, dupe, copy, or similar product.

Users may not use brand names, trademarks, logos, copyrighted content, serial information, authenticity claims, photos, or other listing details in a way that is false, misleading, infringing, or likely to create confusion about authenticity, affiliation, sponsorship, approval, or origin.

Sellers may not claim that Middle Who Market authenticated, inspected, certified, endorsed, appraised or guaranteed an item without an actual, current, item-specific result the platform authorizes them to describe. A paid review request alone is not an authentication result. Buyers and sellers should evaluate the scope and reliability of any item-specific review or documentation they obtain.

1.11 Communications Between Users

The platform may allow users to communicate through comments, messages, seller profiles, listing inquiries, or other communication tools. Users are responsible for their own communications and should use care when sharing personal, payment, location, pickup, or transaction information.

Public comments should be used only for general item-related questions and should not include addresses, phone numbers, payment details, sensitive personal information, or other private information.

Middle Who Market may access, preserve, restrict, or review communications where permitted by law and where reasonably necessary for safety, moderation, legal compliance, fraud prevention, user support, enforcement, or platform operation.

1.12 Local Discovery, Pickup, Shipping, and Transaction Safety

The platform may provide location, ZIP code, radius, local discovery, or related marketplace tools. These tools are discovery features only and do not guarantee exact distance, seller proximity, local availability, transaction completion, user identity, item safety, or pickup safety.

Middle Who Market does not arrange pickups, manage shipping, verify addresses, provide shipping labels, insure shipments, supervise meetings, or guarantee delivery. Buyers and sellers are responsible for choosing safe transaction methods and should use caution when coordinating pickup, delivery, or shipping.

Users should avoid sharing exact addresses, payment information, or sensitive personal details in public comments.

1.13 Intellectual Property

The platform, including its software, design system, source code, database structure, workflows, interface, written content, visual presentation, brand materials, logos, trade names, and related materials, is owned by or licensed to Multiplez LLC and Middle Who Market and is protected by applicable intellectual property laws.

Users may not copy, reproduce, scrape, clone, modify, distribute, create derivative works from, reverse engineer, exploit, or commercially use platform materials without permission, except as applicable law permits.

Users may not upload or post content that infringes or misuses copyrights, trademarks, publicity rights, privacy rights, or other third-party rights. Brand names may be used only in a truthful, descriptive, non-misleading manner to identify an item, and may not be used to imply false affiliation, sponsorship, approval, authentication, or endorsement.

1.14 Reports, Safety Concerns, and Enforcement

Users may report listings, profiles, messages, comments, counterfeit concerns, stolen item concerns, intellectual property concerns, suspicious activity, harassment, private information exposure, fraud, unsafe conduct, or other policy concerns through available report options where shown or by contacting Middle Who Market at info@middlewhomarket.com.

Middle Who Market may review reports, request additional information, preserve records, remove content, restrict visibility, pause listings, remove listings, warn users, suspend accounts, terminate accounts, block access, or take other action consistent with these Terms and platform policies.

Middle Who Market does not guarantee that every report will result in action, that action will occur within a specific timeframe, or that a reported issue will be resolved to a user’s satisfaction.

1.15 Moderation Rights

Middle Who Market may moderate the platform to protect users, the company, marketplace integrity, legal compliance, safety, intellectual property rights, and platform quality.

Middle Who Market may, at its discretion and without prior notice, remove or restrict listings, comments, messages, profiles, photos, or other content; limit account features; require additional information; restrict access; suspend or terminate accounts; preserve evidence; cooperate with lawful requests; or take other action where it believes appropriate.

Middle Who Market may moderate the platform at its discretion, but has no obligation to monitor, screen, verify, review, approve, or remove all content, listings, users, communications, or transactions.

1.16 Legal Compliance, Safety, and Record Preservation

Middle Who Market may preserve, access, review, use, or disclose information where reasonably necessary to comply with law, respond to valid legal process, enforce these Terms, investigate fraud or safety concerns, protect users, protect the platform, protect the rights and property of Middle Who Market or others, or support moderation, trust, safety, security, and legal compliance functions.

1.17 Third-Party Services

The platform may reference or use third-party payment, identity, review, mapping, hosting, analytics or other services. Those providers have their own terms and privacy practices. If a user independently chooses a provider for a Direct Seller Deal, the user should review its terms and risks. This paragraph does not remove Middle Who Market's responsibilities for a platform service it actually offers or rights that applicable law preserves.

1.18 No Professional Advice

Information available through the platform is for general marketplace and informational purposes only. Middle Who Market does not provide legal, tax, financial, investment, insurance, appraisal, authentication, safety, shipping, or professional advice.

1.19 Current Trust Tools and Future Features

Seller identity-status tools may be available where enabled and are separate from item authentication or payout accounts. An optional paid platform trust service, if offered, concerns the specifically described review and does not create checkout for an independent seller's item. We may later introduce item-sale checkout, seller payouts, shipping integrations, buyer protection, paid promotion or other features. An unavailable control or prototype does not create a present service or entitlement. A feature that adds material charges, purchase protection, payment or payout obligations will present applicable disclosures and terms before use.

1.20 Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. Middle Who Market does not warrant that the platform will be uninterrupted, error-free, secure, available at all times, free from harmful components, or that defects will be corrected.

Middle Who Market does not warrant or guarantee any listing, item, user, seller, buyer, transaction, communication, price, condition, authenticity, availability, ownership, legality, safety, shipping, payment, pickup, delivery, or outcome.

1.21 Direct Seller Deal Responsibility

Buyers and sellers are responsible to one another for their Direct Seller Deals. To the extent permitted by applicable law, Middle Who Market does not undertake a seller's or buyer's item-sale duties merely by offering a listing, messaging, identity-status, reporting or moderation tool. A direct-deal dispute about payment, delivery, condition, authenticity or refund is generally for the parties and any relevant payment provider or carrier to address. This section does not disclaim a specific service Middle Who Market actually provides, excuse its own conduct where applicable law does not permit that result, or remove a nonwaivable legal right.

1.22 User Responsibility for Claims

Users are responsible for their own listings, communications, transactions, content, conduct, and legal compliance. Users may be responsible for claims, losses, disputes, or costs arising from their listings, content, transactions, policy violations, intellectual property violations, unlawful conduct, or misuse of the platform.

1.23 Changes to These Terms

We will post an updated version with its effective date and provide appropriate notice of material changes. Changes ordinarily apply prospectively. We will seek affirmative acceptance when required by law or when introducing material item-sale checkout, buyer-protection, seller-payout or comparable obligations through a new feature. An update does not itself turn an earlier Direct Seller Deal into a platform purchase or change terms already presented for a completed transaction. If a change is unacceptable, a user may stop using the affected service, subject to obligations already incurred. We will retain prior versions and acceptance information as appropriate.

2. Privacy Policy

2.1 Overview

This Privacy Policy describes how Middle Who Market, operated by Multiplez LLC, collects, uses, stores, shares, protects and retains information.

It is linked during account creation and remains available to anyone browsing the site. If our practices or your privacy rights raise questions, contact info@middlewhomarket.com before providing information.

2.2 Platform Privacy Position

Middle Who Market provides user listings, accounts, messaging and discovery tools. Buyers and sellers currently arrange item-sale payments, shipping, returns and other direct-deal terms themselves. The platform does not currently provide enabled checkout for user-listed item sales, hold their purchase funds in escrow, release seller sale proceeds, or guarantee those transactions.

The platform may separately offer a paid trust-service review. If a service purchase is available, service order and payment-status information and provider transaction references may be processed separately from any item sale. A fee for a platform service is not a seller's item purchase price or a promise of buyer protection or a positive review outcome.

Users should take care when sharing information with other users. Do not put addresses, payment details, phone numbers, government identification numbers or other sensitive information in public listing, comment or profile fields.

2.3 Data Minimization and Retention Approach

Middle Who Market aims to collect only information reasonably needed to operate, protect, improve, and legally support the platform. Middle Who Market also aims to retain information only as long as reasonably necessary for platform operation, safety, moderation, fraud prevention, legal compliance, dispute resolution, security, or legitimate business needs.

2.4 Information We Collect

Middle Who Market may collect information directly from users, automatically through platform use, from user-generated content, from communications, from reports or moderation activity, from service providers, and from other lawful sources related to platform operation.

Information we may collect includes:

Account information, such as name, display name, email address, login credentials, account status, and account creation records.
Full birthday submitted during account creation for the current age screen.
For new signups through the current form, the Terms version and server acceptance timestamp and the Privacy notice version in authentication metadata; older accounts may have different records.
Profile, seller, closet, showroom, or public marketplace information.
Listing information, including title, brand, category, item details, price, condition, description, photos, listing status, and seller-provided item notes.
Uploaded images, screenshots, profile images, listing photos, or report evidence.
Messages, comments, listing inquiries, support requests, and user communications through the platform.
Saved listings, viewed listings, search activity, browse activity, listing interactions, and local discovery preferences.
ZIP code, radius preference, approximate location from IP address, or general marketplace area where enabled.
Reports, moderation records, admin review records, enforcement actions, safety concerns, intellectual property complaints, counterfeit concerns, or fraud concerns.
Device, technical, and usage information, including IP address, browser type, device type, operating system, referring pages, session data, error logs, security logs, and performance data.
Cookies, local storage, analytics events, or similar technologies used to operate, secure, improve, and measure platform performance.

2.5 Birthday and Age Information

We require a full birthday during account creation to check whether a person meets the current minimum account age of 18. The signup action rejects a missing, invalid, future or under-18 birthday before requesting account creation. For eligible accounts, the submitted birthday is stored in private authentication metadata. It is not displayed on public seller profiles. 2.6 How We Use Information

Middle Who Market may use information to:

Operate, maintain, and provide the platform.
Create and manage user accounts.
Authenticate users and maintain account sessions.
Display listings, seller profiles, and marketplace content.
Enable messaging, comments, saved listings, and discovery features.
Support seller tools and buyer discovery.
Provide user support.
Review reports and safety concerns.
Moderate content and enforce policies.
Investigate counterfeit, stolen item, fraud, harassment, intellectual property, or prohibited-item concerns.
Protect users, the company, and platform integrity.
Prevent spam, abuse, scraping, fraud, unauthorized access, and security incidents.
Maintain audit logs and compliance records.
Communicate service, security, policy, account, legal, safety, or operational updates.
Send marketing communications only where legally permitted and consistent with user choices.
Improve platform functionality, design, performance, and reliability.
Comply with law, legal process, and regulatory obligations.

2.7 Public Information and User-Controlled Sharing

Some information users provide may be public or visible to other users, including listing content, listing photos, seller profile information, public comments, public display names, and other information submitted to public platform areas.

Users are responsible for the information they choose to post publicly or share directly with other users. Middle Who Market is not responsible for how other users use information that a user publicly posts or voluntarily shares.

2.8 Messages, Comments, and Communications

Messages are intended to be visible to the users participating in the communication and to authorized company systems, administrators, moderators, or service providers where reasonably necessary for platform operation, support, safety, moderation, legal compliance, fraud prevention, or enforcement.

Users should not share sensitive information unless they understand the risks and are comfortable with the recipient and transaction context.

2.9 Reports, Safety, Moderation, and Enforcement Records

Middle Who Market may collect, create, and retain information related to reports, safety issues, moderation activity, intellectual property complaints, counterfeit concerns, policy violations, and enforcement actions.

Report and moderation records may be retained after account deletion or listing removal where reasonably necessary for legal, safety, fraud-prevention, audit, dispute-resolution, enforcement, or compliance purposes.

2.10 Cookies, Analytics, and Similar Technologies

Middle Who Market may use cookies, local storage, pixels, analytics tools, session technologies, or similar technologies to operate the platform, remember user preferences, maintain sessions, improve performance, understand platform usage, prevent abuse, and support security.

If Middle Who Market uses advertising, retargeting, cross-context behavioral advertising, or similar tools that require additional disclosures or choices, Middle Who Market will provide legally required notices or options where applicable.

2.11 How We Share Information

Middle Who Market may share information:

With other users when users post listings, create profiles, comment, message, or otherwise communicate through the platform.
With service providers that help host, operate, secure, analyze, support, or improve the platform.
For safety, fraud prevention, intellectual property review, moderation, and policy enforcement.
To comply with law, legal process, subpoenas, court orders, law enforcement requests, regulatory requests, or legal claims.
In connection with a merger, acquisition, restructuring, financing, sale of assets, bankruptcy, or similar transaction involving the company.
With consent or at the user's direction.

Middle Who Market does not currently process a purchase price or manage shipping for a Direct Seller Deal between independent users. If we offer a paid platform trust service, the service order and payment may be handled through Stripe or another identified payment provider; that service transaction remains separate from a seller's item sale.

2.12 Service Providers and Infrastructure

Middle Who Market may use third-party service providers to support hosting, databases, authentication, email delivery, analytics, security, monitoring, storage, development, and other platform operations.

Current or expected infrastructure providers may include Supabase for database and authentication, Vercel for hosting, and providers of email, analytics, monitoring, security, support and storage. Stripe may process a separately offered paid trust-service checkout or seller identity verification where those flows are enabled. Any provider handles information within the scope of the particular feature used.

2.13 Data Retention

Middle Who Market may retain information for as long as reasonably necessary to operate the platform, provide services, maintain accounts, display listings, support user communications, comply with legal obligations, resolve disputes, enforce agreements, preserve evidence, prevent fraud or abuse, maintain security, and support legitimate business needs.

Retention periods may vary depending on the type of information, user activity, legal requirements, safety concerns, moderation needs, dispute history, and operational requirements.

2.14 Account Deletion and Privacy Requests

Users may request account deletion, data access, data correction, or other privacy-related assistance by contacting Middle Who Market.

To help process a request, users may need to provide information sufficient to verify the account or request. Middle Who Market may deny or limit a request where permitted by law, including where information must be retained for legal, security, fraud-prevention, enforcement, dispute-resolution, audit, or compliance reasons.

2.15 State Privacy Rights

Depending on where a user lives and whether applicable legal thresholds are met, the user may have certain rights under applicable privacy laws, which may include rights to access, correct, delete, obtain a copy of, or opt out of certain uses or disclosures of personal information.

2.16 Sale or Sharing of Personal Information

Middle Who Market does not intend to sell personal information in the ordinary sense of exchanging user personal information for money.

Certain privacy laws may define “sale,” “sharing,” “targeted advertising,” or similar terms broadly. If Middle Who Market uses advertising, analytics, pixels, retargeting, cross-context behavioral advertising, or similar tools that trigger legal notice or opt-out requirements, the platform will provide required disclosures or choices where applicable.

2.17 Children and Minors

Middle Who Market account features are intended only for people who are 18 years old or older. The signup action rejects a supplied birthday indicating someone is under 18 before requesting an account. Minors may not create or use a Middle Who Market account, including through an account created or operated on their behalf by a parent or guardian. People who do not meet applicable account or feature eligibility requirements may not use those features.

If Middle Who Market learns that it has collected information from a user who does not meet applicable eligibility requirements, it may delete the information, restrict the account, or take other appropriate action.

2.18 Security

Middle Who Market uses reasonable administrative, technical, and organizational measures designed to protect information. However, no website, app, database, transmission, communication system, or storage system is completely secure.

Users are responsible for maintaining the confidentiality of account credentials and for using care when sharing information with other users. Middle Who Market cannot guarantee that unauthorized access, security incidents, data loss, misuse, or errors will never occur.

2.19 Changes to This Privacy Policy

We will post a revised Privacy Policy with an effective date and provide appropriate notice of material changes. We will request additional consent when required by law or the affected feature.
