Middle Who Market is operated by Multiplez LLC and currently functions as a listing and communication platform. Important Platform Reminder Middle Who Market is a listing and communication platform. Buyers and sellers arrange payment, pickup, delivery, shipping, authentication, inspection, returns, refunds, and transaction terms directly with each other. Middle Who Market does not process payments, hold funds, provide escrow, ship items, authenticate items, inspect items, verify item condition, or guarantee transactions. Policy Hierarchy These policies should be read together. If a specific policy section applies to a particular issue, that section controls for that issue unless updated or replaced by a later policy. The platform allows users to create accounts, browse listings, post listings, communicate with other users, save listings, use discovery tools, and coordinate potential transactions directly with each other. Middle Who Market does not own, sell, purchase, inspect, authenticate, appraise, verify, ship, store, or take possession of items listed by users. Middle Who Market is not a party to transactions between buyers and sellers. Buyers and sellers are solely responsible for arranging and agreeing to all transaction terms, including payment method, item condition, authenticity review, pickup, delivery, shipping, insurance, returns, refunds, and any other transaction details. 1.3 No Platform Payments, Escrow, Shipping, Authentication, or Guarantees Middle Who Market does not currently process payments, hold funds, provide escrow, manage seller payouts, issue shipping labels, ship items, inspect items, authenticate items, verify condition, guarantee item availability, guarantee user identity, guarantee listing accuracy, or guarantee transaction outcomes. Any payment, pickup, delivery, shipping, authentication, inspection, or final transaction arrangement is made directly between the buyer and seller. Users are responsible for evaluating whether and how to proceed with any transaction. Middle Who Market is not responsible for off-platform payments, failed payments, chargebacks, refunds, payment disputes, shipping loss, shipping damage, pickup disputes, non-delivery, no-shows, item-not-as-described disputes, or any other transaction issue between users. 1.4 Eligibility and Accounts Users must be legally able to use the platform and comply with applicable laws. Before completing a transaction, buyers should review the listing carefully, ask appropriate questions, request additional photos or documentation where needed, evaluate the seller’s communications, and decide whether the transaction method is acceptable. Middle Who Market does not guarantee that any listing is accurate, complete, available, authentic, lawful, safe, properly priced, or suitable for purchase. Buyers are responsible for their own due diligence and should not send payment, share sensitive information, or meet in person unless they are comfortable with the seller, item details, transaction method, and safety arrangements. Users who choose to transact directly should preserve relevant communications, listing details, payment records, shipping records, pickup details, authentication documents, and other transaction records for their own protection. 1.6 Seller Responsibilities Sellers are solely responsible for all listings and communications they submit through the platform. By posting a listing, the seller represents that: 1. The seller owns the item or has the legal right and authority to sell it. 2. The listing is accurate, truthful, and not misleading. 3. The item is not counterfeit, replica, stolen, unlawful, unsafe, restricted, recalled, or prohibited. 4. The seller has disclosed material flaws, damage, repairs, odors, missing accessories, uncertainty, and condition issues known to the seller. 5. The seller will not misrepresent authenticity, brand affiliation, condition, value, rarity, availability, or transaction terms. 6. The seller will not state or imply that Middle Who Market has authenticated, inspected, approved, verified, guaranteed, or endorsed the item, seller, listing, or transaction. 7. The seller will promptly update, pause, or remove listings that are sold, unavailable, inaccurate, incomplete, or no longer offered. Seller profiles, closets, listings, badges, public pages, or other platform features do not create an agency, partnership, employment, franchise, endorsement, verification, or certification relationship between the seller and Middle Who Market. 1.7 Listings, Condition, and User-Provided Information Listing titles, descriptions, categories, brands, prices, photos, condition labels, measurements, materials, accessories, serial details, authenticity details, and other listing information are provided by users, not by Middle Who Market. Condition labels and item descriptions are seller-provided guidance only. They are not platform verification, authentication, appraisal, warranty, guarantee, or inspection. Middle Who Market may provide listing fields, condition categories, seller tools, discovery tools, or marketplace formatting, but these tools do not mean that Middle Who Market has reviewed, approved, authenticated, inspected, verified, or guaranteed any listing. 1.8 User Content License Users may submit, upload, post, display, transmit, or otherwise make available content through the platform, including listings, descriptions, photos, profile information, messages, comments, and other materials. Users retain any rights they may have in their content. By submitting content to the platform, users grant Middle Who Market a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, format, transmit, distribute, modify for formatting or technical purposes, and otherwise use the content as reasonably necessary to operate, provide, improve, moderate, protect, and promote the platform. Users represent that they own or have all necessary rights to submit their content and that their content does not violate these Terms, any platform policy, any law, or any third-party rights. Middle Who Market may remove, restrict, disable, or preserve user content at its discretion, including where it believes the content violates these Terms, violates platform policies, infringes rights, creates safety concerns, creates legal risk, or is otherwise unsuitable for the platform. 1.9 Prohibited Items and Conduct Users may not list, offer, promote, request, or attempt to transact in prohibited items. Users may not misuse the platform, post false or misleading listings, misrepresent identity or item details, harass others, evade moderation, scrape platform data, interfere with platform operation, or use the platform for unlawful, unsafe, fraudulent, infringing, or abusive conduct. Middle Who Market may investigate suspected prohibited conduct and take enforcement action at its discretion. 1.10 Counterfeit, Replica, Stolen Goods, and Authenticity Rules Counterfeit goods, replica goods, stolen goods, and intentionally misleading listings are prohibited. Replica items are prohibited even if the listing discloses that the item is a replica, imitation, inspired-by item, dupe, copy, or similar product. Users may not use brand names, trademarks, logos, copyrighted content, serial information, authenticity claims, photos, or other listing details in a way that is false, misleading, infringing, or likely to create confusion about authenticity, affiliation, sponsorship, approval, or origin. Sellers may not state or imply that Middle Who Market has authenticated, inspected, approved, verified, certified, endorsed, appraised, or guaranteed any item. Middle Who Market does not authenticate items. Buyers and sellers are responsible for any authentication, inspection, verification, or documentation they choose to obtain or rely on. 1.11 Communications Between Users The platform may allow users to communicate through comments, messages, seller profiles, listing inquiries, or other communication tools. Users are responsible for their own communications and should use care when sharing personal, payment, location, pickup, or transaction information. Public comments should be used only for general item-related questions and should not include addresses, phone numbers, payment details, sensitive personal information, or other private information. Middle Who Market may access, preserve, restrict, or review communications where permitted by law and where reasonably necessary for safety, moderation, legal compliance, fraud prevention, user support, enforcement, or platform operation. 1.12 Local Discovery, Pickup, Shipping, and Transaction Safety The platform may provide location, ZIP code, radius, local discovery, or related marketplace tools. These tools are discovery features only and do not guarantee exact distance, seller proximity, local availability, transaction completion, user identity, item safety, or pickup safety. Middle Who Market does not arrange pickups, manage shipping, verify addresses, provide shipping labels, insure shipments, supervise meetings, or guarantee delivery. Buyers and sellers are responsible for choosing safe transaction methods and should use caution when coordinating pickup, delivery, or shipping. Middle Who Market may review reports, request additional information, preserve records, remove content, restrict visibility, pause listings, remove listings, warn users, suspend accounts, terminate accounts, block access, or take other action consistent with these Terms and platform policies. Middle Who Market does not guarantee that every report will result in action, that action will occur within a specific timeframe, or that a reported issue will be resolved to a user’s satisfaction. 1.15 Moderation Rights Middle Who Market may moderate the platform to protect users, the company, marketplace integrity, legal compliance, safety, intellectual property rights, and platform quality. Middle Who Market may, at its discretion and without prior notice, remove or restrict listings, comments, messages, profiles, photos, or other content; limit account features; require additional information; restrict access; suspend or terminate accounts; preserve evidence; cooperate with lawful requests; or take other action where it believes appropriate. Middle Who Market may moderate the platform at its discretion, but has no obligation to monitor, screen, verify, review, approve, or remove all content, listings, users, communications, or transactions. 1.16 Legal Compliance, Safety, and Record Preservation Middle Who Market may preserve, access, review, use, or disclose information where reasonably necessary to comply with law, respond to valid legal process, enforce these Terms, investigate fraud or safety concerns, protect users, protect the platform, protect the rights and property of Middle Who Market or others, or support moderation, trust, safety, security, and legal compliance functions. 1.17 Third-Party Services The platform may reference, link to, or interact with third-party services, websites, payment providers, shipping providers, authentication providers, mapping tools, analytics tools, hosting providers, or other external services. Middle Who Market does not control third-party services and is not responsible for their content, policies, practices, availability, security, fees, decisions, or performance.
